If you are married less than two years when your green card is approved, you will receive a conditional green card for two years. Within 90 days before your conditional green card expire, you need to file a petition to remove conditions jointly with your spouse. If you cannot file a joint petition (for example, you are divorced), you can file a waiver of the joint filing if you can demonstrate (1) extreme hardship if you were deported, (2) you entered into your marriage in good faith but your marriage was terminated other than through death of your spouse, (3) you were battered or subjected to extreeme cruelty perepetrated by your spouse or (4) your spouse was in bigamous relationship and you were subjected to battering or extreme cruelty.
